Who is our newly admitted Notary Public?
At Zed Legal, we are proud to announce that our Founder, Bruno Confalone, has recently been admitted as an Australian Notary Public by the Supreme Court of South Australia. It is a privilege and an honour to have a Notary Public within our firm, and we set out below how this service may be of assistance to you.
What does it mean to be a Notary Public?
A solicitor may apply to become an Australian Notary Public by having held a practicing certificate for at least five years, and by having completed a course of study related to notorial practice. Upon being admitted as an Australian Notary Public, a number of powers are given to that individual. These powers relate to witnessing documents, administering oaths and performing a wide range of administrative functions. More specifically, a Notary Public is given the power to do the following:
- verify documents for use internationally,
- certify copy documents for use internationally,
- attest documents and certify their proper execution for use internationally,
- prepare and certify wills, powers of attorney, deeds, contracts and other legal documents for use internationally,
- administer oaths for Australian documents as well as international documents,
- witness signatures to affidavits, statutory declarations, powers of attorney, contracts and other legal documents for use internationally,
- exemplify official documents for use internationally,
- note and protest bills of exchange, and
- prepare ships’ protests.
What is the difference between a Notary Public and a Justice of the Peace?
As can be seen above, a Notary Public is given a broad range of powers in both a national and an international capacity. The main difference between a Notary Public and a Justice of the Peace is the fact that a Notary Public’s powers have an international capacity, whereas a Justice of the Peace’s power is limited for use within Australia.
